Putting Your Home under Contract!
The Basic procedures


By this time you should have found an attorney that you feel comfortable with. If your realtor or friend recommends an attorney, then my suggestion is to try them. Word of mouth is always the best. Please make sure they are a real estate attorney and not some other expertise. It will only be to your best interest to find an attorney that is versed in real estate.

As we spoke on another page, your attorney will want the original deed and survey that you have on your home. Also, any CO’s you may have acquired from extensions, decks or pools. The seller’s attorney always draws up the contracts and sends them over to the buyer’s attorney. The buyer’s attorney will look over the contract and have his client sign first with the down payment check.

Usually there is a rider attached to the contract. This is for any requests or changes in the contract. It is sent back over to the seller’s attorney to look over the changes. After the back and forth a few times, and everything is agreed upon both parties the seller will then sign the contract. The down payment is taken by the seller’s attorney and put into an escrow account until the closing of the property.
